Tony McAvoy SC, Natasha Case and Winsome Hall were successful in an appeal to the Full Court of the Federal Court on behalf of native title claimants in Gomeroi People v Santos NSW Pty Ltd and Santos NSW (Narrabri Gas) Pty Ltd [2024] FCAFC 26.
The Applicant native title claimants successfully argued that the Tribunal did not properly consider the effects of climate change as part of its mandatory considerations required under section 39(1) of the Native Title Act 1993 (Cth).
