Melanie Cairns will be speaking on the differences that can arise in a proportionate liability defence to professional negligence claims in tort, contract or for misleading conduct.
Melanie considers:
1. The apportionment exception: When can the court order two parties 100% liable for a loss?
2. Can a plaintiff frame their claim to limit proportionate liability exposure (e.g. by seeking relief under s 237 instead of s 236, ACL)?
3. How else may a claim in tort or contract differ from a misleading conduct claim under the Competition and Consumer Act 2010 (Cth) or its analogues?
