The Federal Court of Australia has delivered its judgment in a case described as a landmark decision for product liability class actions in Australia. The Court has found that nine medical devices manufactured by entities within the Johnson & Johnson group had a defect and that representations contained in instructions for use and marketing material accompanying the products was misleading or deceptive.
